These Terms of Service (the “Terms”) govern access to and use of mississijewelry.com (the “Site”) and purchases from MISSISSI Fine Jewelry. “MISSISSI,” “we,” “us,” and “our” mean Shenzhen Mississi Jewelry Co., Ltd.
By using the Site or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site or place an order.
1. Eligibility and customer information
You must be legally capable of entering into a binding contract in your place of residence to place an order. You agree to provide accurate, current, and complete account, billing, payment, contact, and shipping information. You must not use another person’s information or payment method without authorization.
If you create an account, you are responsible for safeguarding your login information and for activity under your account.
2. Product information and customization
We aim to describe and display products accurately. Screen settings, photography, lighting, and normal material or manufacturing variations may affect how colors, scale, and details appear. Product descriptions, availability, and customization options may change before an order is accepted.
A product described as made-to-order is not automatically a custom or personalized product. For return purposes, a custom or personalized product is one made to the customer’s specifications, resized specifically for the customer, engraved, personalized, or otherwise customized.
You are responsible for reviewing and approving names, sizes, measurements, engraving, stone, metal, design, and other custom details before production begins.
3. Orders and acceptance
Submitting an order is an offer to purchase. An automated confirmation acknowledges receipt but does not necessarily mean that we have accepted the order. We may decline or cancel an order before fulfillment because of suspected fraud, payment failure, product or material unavailability, an obvious pricing or description error, shipping restrictions, or legal requirements. If we cancel an order after payment has been captured, we will refund the amount charged for the canceled item or order.
We may contact you to confirm custom details or obtain information needed to fulfill the order. A delay in receiving required information may delay preparation.
4. Prices and payment
The price charged is the price displayed at checkout when the order is placed, subject to correction of an obvious error. You authorize MISSISSI and its payment providers to charge the payment method submitted for the order and any amounts clearly disclosed at checkout.
Prices and promotions may change before an order is placed. A promotion may be subject to separate terms. Changes will not alter the price of an accepted order unless you agree or applicable law permits the change.
5. Shipping, duties, and taxes
MISSISSI offers free standard shipping worldwide to destinations available at checkout. Orders have an estimated preparation period of 15 business days before dispatch. This is an estimated preparation time, not a guaranteed shipment or delivery date. Business days exclude weekends and public holidays observed by MISSISSI's operations in Shenzhen, China.
Delivery time after dispatch depends on the destination, carrier operations, customs clearance, weather, and other circumstances. Tracking information will be provided when available. See our Shipping Policy for details.
Customs duties, import taxes, VAT, customs-clearance or brokerage fees, and local charges are the customer’s responsibility unless checkout expressly states otherwise. MISSISSI does not control these charges or customs processing.
If an order cannot be dispatched within the stated preparation period, MISSISSI will contact the customer with updated information and provide the applicable options to accept the delay or cancel the unshipped order for a full refund to the original payment method.
6. Cancellations
An order may be canceled for a full refund within 24 hours after payment only if production has not started. Production is considered started when stone selection, material sourcing, CAD or design work, sizing, engraving, personalization, or physical manufacturing has begun.
Except where mandatory law requires otherwise, a cancellation request submitted more than 24 hours after payment or after production has started may be declined. Custom or personalized orders cannot be canceled for non-quality reasons after production has started.
MISSISSI does not charge a cancellation or restocking fee under this policy.
Shipping-delay cancellation rights are addressed in Section 5 and the Shipping Policy. Returns after delivery are governed by the Refund Policy.
7. Returns, claims, and refunds
Our Refund Policy separately explains ordinary returns, custom and personalized products, visible quality issues, wrong items, shipping damage, refused international deliveries, and lost-package claims. Direct exchanges are not offered. An eligible non-custom item must be returned and inspected before the customer places a new order.
Before sending any return, the customer must obtain written return authorization and instructions as described in the Refund Policy. This process does not by itself extinguish any statutory withdrawal right that applies under mandatory law.
Nothing in these Terms or the referenced policies overrides a mandatory consumer right or remedy.
8. Accuracy and corrections
We may correct typographical, pricing, product-description, availability, or other Site errors. If a correction materially affects an order already placed, we will contact you and provide any choice or remedy required by applicable law.
9. Acceptable use
You may use the Site only for lawful purposes. You must not:
- violate applicable law or another person’s rights;
- submit false, fraudulent, abusive, or misleading information;
- introduce malware or interfere with the Site’s security or operation;
- attempt unauthorized access to the Site, accounts, or systems;
- collect personal information about others without authorization; or
- copy, reproduce, resell, or commercially exploit Site content without written permission, except as allowed by law.
We may restrict or terminate access when reasonably necessary to protect the Site, customers, MISSISSI, or third parties, or to comply with law.
10. Intellectual property
The Site and its original content, including text, photographs, graphics, logos, designs, videos, and other materials, are owned by or licensed to MISSISSI and are protected by applicable intellectual-property laws. You may use the Site for personal, noncommercial shopping purposes only. Your use of the Site does not transfer any ownership right.
11. Customer content and feedback
If you submit a review, image, comment, or other content, you confirm that you have the right to submit it and that it does not violate law or another person’s rights. You grant MISSISSI a nonexclusive, worldwide, royalty-free license to use, reproduce, display, and adapt that content to operate and promote the Site and products, subject to our Privacy Policy and applicable law. This license does not by itself authorize use of your content in a separate paid advertisement; MISSISSI will obtain any additional permission required for that use. You remain responsible for the content you submit.
12. Third-party services and links
The Site may use or link to services provided by payment processors, carriers, platform providers, and other third parties. Their services may be governed by separate terms and privacy practices. MISSISSI is not responsible for third-party sites or services that it does not control, except to the extent responsibility cannot be excluded by law.
13. Privacy
Our collection and use of personal information are described in the MISSISSI Privacy Policy. Online services and cross-border fulfillment may involve processing by service providers in multiple locations, as explained in that policy.
14. Site availability
We may update, suspend, or discontinue Site features for maintenance, security, legal, or operational reasons. We do not promise that the Site will always be uninterrupted or error-free.
15. Disclaimers
To the maximum extent permitted by applicable law, the Site is provided on an “as available” basis. We do not make warranties beyond those expressly stated in a product description, written order confirmation, or applicable policy. Some jurisdictions do not allow certain warranty exclusions, so those exclusions may not apply to you.
Nothing in these Terms excludes or limits any warranty, consumer guarantee, right, remedy, or liability that cannot lawfully be excluded or limited.
16. Limitation of liability
To the maximum extent permitted by applicable law, MISSISSI will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss arising from use of the Site or products. Where liability may lawfully be limited, MISSISSI’s total liability relating to an order will not exceed the amount paid for the product giving rise to the claim.
This limitation does not apply to fraud, willful misconduct, death or personal injury caused by negligence where liability cannot be limited, or any other liability that applicable law does not permit us to exclude or limit.
17. Indemnification
To the extent permitted by law, you agree to reimburse MISSISSI for reasonable losses and costs resulting from your unlawful use of the Site, your material breach of these Terms, or your violation of another person’s rights. This section does not require you to indemnify MISSISSI for its own unlawful conduct, negligence, or breach.
18. Termination
You may stop using the Site at any time. We may suspend or terminate access for a material violation of these Terms, fraud, security risk, or legal requirement. Provisions that by their nature should continue after termination, including intellectual-property, liability, and dispute provisions, will survive.
19. Changes, severability, and waiver
We may update these Terms from time to time. The revised version will be posted with a new effective date. Where required by law, we will provide additional notice. Changes will not retroactively reduce rights that already apply to an accepted order unless applicable law permits it.
If a provision is held unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.
20. Governing law and jurisdiction
These Terms and disputes arising out of or relating to them are governed by the laws of the People’s Republic of China, without regard to conflict-of-law principles. Subject to mandatory consumer-protection laws that apply to the customer, courts with competent jurisdiction in Shenzhen, Guangdong Province, China have jurisdiction.
